Proof Of Separation For Divorce


Will I need some sort of proof of separation that my husband and I have lived apart for a year and a day?

Generally no – the courts usually take your word for it, unless one spouse decides to contest the assertion that you have been separated for that period of time or that there was no intention to remain separate and apart. If needed, proof could be in the form of a utility bill, rental agreement with new landlord, mail delivered at your new address, a voter registration card or driver’s license, etc.

There are cases when one spouse may want to get divorced sooner than permitted by law. There are also cases when one spouse may fight about when the separation occurred in an attempt to slow the divorce process or simply to cause aggravation to their spouse. Also, property classification is determined by when it was acquired. If a spouse wants to speed up the divorce process, it should cause warning signs to flash and you should investigate why they want to push the process faster than necessary; especially if the legal issues are not yet resolved.
